  • A Special Needs Trust established by the disabled person’s parent, grandparent, legal guardian or a Court.
  • The Trust does not result in any Medicaid disqualification period for the beneficiary or for the Grantor. 
  • The beneficiary must be under 65 when the Trust is established. 
  • Upon the beneficiary’s death any remaining assets must be used to payback Medicaid for the benefits paid out to the deceased beneficiary. 
  • These types of Trusts are usually funded with money awarded to the disabled person as a result of medical malpractice or from a personal injury award. 
  • The terms “Special Needs Trust” and “Supplemental Needs Trust” are frequently used as if they were interchangeable.
